Can You Mail Vape Pens with USPS?

Shippers cannot send electronic cigarettes or vapes via the United States Postal Service’s network. In a final order that was announced on October 21, 2021, the United States Postal Service (USPS) made it illegal for individuals and small companies to transmit vapes via the mail. This judgment also applies to electronic cigarettes and other nicotine products powered by batteries.

The long-awaited Final Rule governing the mailability of electronic nicotine delivery system (ENDS) goods via the United States Postal Service (USPS) was finally released on October 21, 2021. This rule also clarified which items are covered by this rule and which products are not covered by this rule.


The USPS ban covers both nicotine and cannabis vapes.

POSECCA’s explicit wording compelled the United States Postal Service to ban the shipment of any vaping product via the United States Mail. During its response to the comments, the United States Postal Service said that it simply does not possess the authority to deviate from the language of Congress, which does not differentiate between the things meant to be vaporized by “ENDS.”

Because it modified the original PACT Act to include e-cigarettes and vapor goods, the Preventing Online Sales of E-Cigarettes to Children Act had significant support from the National Association of Cigarette Sales (NACS). This act mandated that online dealers of these items must guarantee that an in-person ID check takes place at delivery time.

Are There Any Exceptions for Mailing Vape Pens?

There are a few exemptions to the many laws that prohibit the shipment of ENDS even though there are a significant number of such laws.

  • The states of Alaska and Hawaii permit the shipping of vape pens inside their respective states.
  • Shipments between firms in the tobacco sector that have been validated and approved to do business* These companies also can transmit vapes to state or federal authorities for regulatory compliance.
  • Once every thirty days, adults are permitted to send up to ten electronic nicotine delivery devices for use in non-commercial settings.
  • It is permissible for producers to send a limited quantity of electronic cigarettes to adult smokers for consumer testing. These shipments must be confirmed and approved.
  • It is permissible for federal agencies to transport a limited quantity of vaping items to protect public health standards.

*For companies to send vaping items as a verified entity, they need to apply to the United States Postal Service (USPS) to confirm whether or not they are eligible for the exemption.


Does USPS check packages for drugs?

Postal inspectors may screen packages to determine whether or not they contain narcotics such as marijuana or other substances. Some individuals may try to transmit drugs over the mail because they are under the impression that the Fourth Amendment guarantees them protection from having their shipments examined.
